What Is DUI With Drugs

DUI with Drugs is also known as Drug Driving and is the term used for a DUI when the ability to drive is impaired by the use of any controlled substance or “drug”. In the State of Nevada Driving Under the Influence of Drugs is specified under Nevada Law 484C where the following controlled substances are detailed:

  • Amphetamine
  • Cocaine or cocaine metabolite
  • Heroin or heroin metabolite (morphine or 6-monoacetyl morphine)
  • Lysergic acid diethylamide (LSD)
  • Marijuana or marijuana metabolite
  • Methamphetamine
  • Phencyclidine (PCP)

The only real qualifier as to what counts as a Drug is that it must “affect the nervous system, brain, or muscles” causing impairment and thus effects your driving. Having nearly any drug in your body can result in a DUI with Drugs charge. Drug Driving is not uncommon. A survey done by the National Highway Traffic Safety Administration (NHTSA) found that 1 in 8 weekend night-time drivers tested positive for the use of controlled substances.

Drug Driving frequently involves the combined use of both a controlled substance with alcohol. DUI with Marijuana

The recreational use of cannabis (marijuana) is legal for everyone 21 years or older in Nevada. It is illegal to be under the influence of marijuana and drive. Nevada Law determines a person to be under the influence of marijuana based on a blood or urine chemical test:

  • Marijuana – 2 nanograms per milliliter
  • Marijuana metabolite —5 nanograms per milliliter

Driving with certain detectable amounts of THC or marijuana metabolites can result in Driving Under the Influence of Drugs (DUI with Drug) charges.
